Michael J Daugherty
President & CEO | LabMD
Michael is President and CEO of LabMD, an Atlanta-based clinical and anatomic medical laboratory with a national client base. He has spent most of the last decade defending his company against charges that it had deficient cybersecurity practices.
The early years of his entering and fighting in Washington, DC are recorded in his book “The Devil Inside the Beltway”. In doing so, he is the only litigant to challenge the basic authority that underlies more than 200 enforcement actions relating to cybersecurity and online privacy that the FTC has brought over the past 15 years. Every one of the 200+ litigants before him – including some of the largest companies in the world, have settled with the FTC, creating an unquestioned and untested belief that the FTC has broad authority to regulate in these areas. Following oral arguments in June 2017, before a panel of the 11th Circuit Court of Appeals, it seems entirely possible that he will prevail. In so doing, he may well topple key pillars of the FTC’s cybersecurity and online privacy edifice, successfully exposing and challenging the Administrative state.
Partner | Ropes & Gray
Recently knocking the wind out of the FTC’s regulatory power via the LabMD case, Chambers has named Doug Meal the top cybersecurity lawyer in the United States. Everyone, especially your legal team, will want to take this rare opportunity to be in the same room with Doug Meal. He is praised for his hard-nosed approach to handling disputes, with one source describing him as “a wrecking ball litigator. He fights trench warfare in the payment card industry and is excellent at that,” remarks an industry insider.
A seasoned pro at government enforcement matters and incident response, Doug Meal co-leads Ropes & Gray’s privacy and cybersecurity practice. As the lead outside lawyer handling claims stemming from the data security breaches suffered by Target, Neiman Marcus, The Home Depot, Arbys, Supervalu, Sally Beauty, Sony, Heartland Payment Systems, TJ Maxx, Hannaford Brothers, Aldo, Genesco, and Wyndham Hotels – some of the most highly publicized data security breaches in recent years – Doug has become the national leader in defending companies that suffer significant cybersecurity breaches involving consumer information against the ensuing claims and regulatory investigations.
